These Terms & Conditions apply to all orders placed via the website www.123blumen.at. The operator is 123Blumen.at GmbH, Vy-d'Etra Str. 100, CH-2000 Neuchâtel.
By placing an order, you accept these Terms & Conditions in their current version. Deviating conditions of the customer are not recognised.
By submitting an order on our website, you make a binding offer to conclude a purchase contract. The contract is concluded as soon as we confirm your order by email.
We reserve the right to reject orders without stating reasons, in particular if the desired delivery address is outside our delivery area or the order time does not allow timely delivery.
All prices are final prices in euros (EUR) and include the statutory Austrian VAT and delivery costs, unless otherwise stated.
We accept the following payment methods:
Payment is due upon placing the order. In the event of payment failure, we reserve the right to cancel the order.
We deliver flowers exclusively within Austria, through local partner florists.
In the event of non-delivery due to an incorrect address or the recipient's absence without prior notification, we cannot guarantee a refund. Please ensure the delivery address is correct and the recipient is reachable.
Fresh flowers and plants are rapidly perishable goods. Pursuant to § 18 para. 1 no. 2 FAGG (Austrian Distance Selling Act), no right of withdrawal applies to such goods.
However, if your order was delivered incorrectly (wrong products, significant quality defects), please contact us within 24 hours of delivery by email with a description and photo of the defect. We will consider an appropriate solution (replacement or credit).
123Blumen.at is only liable for damages in cases of intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law.
We accept no liability for:
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The mandatory consumer protection provisions of the state in which the consumer has their habitual residence also apply.
The place of jurisdiction for disputes with merchants is Vienna. For disputes with consumers, the statutory place of jurisdiction applies.
